The article offers an analysis of the fusion of customary law with the newly adopted statutory system as one of the major constraints that compounded the challenges faced by the Judiciary, and offers suggestions on how the Judiciary of South Sudan should have dealt with customary law before adopting the common law system in haste.
1. Historical Introduction. The Republic of South Sudan became a sovereign nation on July 9, 2011. The date marked the end of a long fight for independence, which spanned two civil wars (1955-1972, 1983-2005), the signing of a Comprehensive Peace Agreement (CPA) in 2005, and ultimately a referendum on self-determination in January 2011.
